- USCIS guarantees a decision (approval, denial, RFE, or NOID) within the processing window
- If USCIS misses the deadline, they refund the I-907 fee and continue processing for free
- An RFE pauses the clock — the timer restarts when USCIS receives your response
- Premium processing cannot be requested for I-485 Adjustment of Status
- The I-907 fee is paid separately from the base petition fee

💡 Who pays? For H-1B and other employer-sponsored petitions, the employer typically pays the base fee. The employee may voluntarily pay the I-907 premium fee — but employers cannot require it as a condition of sponsorship.
⚠️ Business days only: The processing clock counts business days, not calendar days. Weekends and federal holidays are excluded. During peak H-1B season, USCIS may temporarily suspend premium processing.
