Frequently Asked Questions

Can I work while my EAD renewal is pending?

Yes, for most EAD categories. If you filed for renewal before your current EAD expired, an automatic extension of up to 540 days applies while your renewal is pending. You can continue to work using your expired EAD card plus the USCIS receipt notice (I-797C) as a combination document. This rule applies to most categories except for initial EADs and certain humanitarian categories.

How early should I renew my green card?

USCIS recommends filing the I-90 within 6 months before your green card expiration. Processing typically takes 12–18 months, so your current card may expire while the renewal is pending — that's normal and your receipt notice extends your status by 24 months. You can also file the I-90 after your card has expired, since LPR status is not affected by card expiration.

Do I need advance parole if I have a valid H-1B visa?

Generally no. H-1B, H-4, L-1, L-2, O-1, and certain other dual-intent visa holders can travel internationally while an I-485 is pending without advance parole, as long as their current visa remains valid and they can be readmitted in that status.
